Domestic Staff Naija – A Service of DOMO Consulting

This Service Agreement ("Agreement") is made between:

The Client (hereinafter referred to as the "Employer," which expression shall, where the context so admits, include his/her heirs, assigns, privies, successors-in-title, and personal representatives)

AND

DOMO Consulting (hereinafter referred to as the "Agency," which expression shall, where the context so admits, include its successors, assigns, and representatives).

By registering on our platform, engaging our services, or marking "I Agree," the Employer accepts and agrees to be bound by the terms set out below.

1Subject Matter

This Agreement governs the recruitment and placement of domestic staff by the Agency on behalf of the Employer under the terms and conditions contained herein.

2Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria.

3Obligations of the Agency

  • 3.1.The Agency shall identify suitable candidates for domestic roles through advertising, database search, referrals, or collaboration with partner agencies.
  • 3.2.The Agency shall provide preliminary orientation to candidates regarding their general duties and conduct as domestic staff.
  • 3.3.The Agency shall conduct screening and security checks, including identity and address verification of candidates and their guarantors. Relevant security details shall be made available to the Employer.
  • 3.4.The Agency may publish eligible candidate profiles on its platform or website.
  • 3.5.The Agency shall execute an employment contract with any staff engaged through its services. Such contract shall include a minimum one-year engagement clause, subject to the terms of this Agreement.

4Obligations of the Employer

  • 4.1.The Employer shall interview shortlisted candidates and make the final hiring decision.
  • 4.2.The Employer shall conduct relevant medical tests on the selected candidate where necessary.
  • 4.3.The Employer shall make all agreed payments promptly.
  • 4.4.The Employer shall not subject any staff to physical, emotional, verbal, psychological, or sexual abuse and shall ensure a safe and respectful working environment.
  • 4.5.The Employer shall provide a minimum of two (2) days off per month to live-in domestic staff.
  • 4.6.The Employer shall provide at least two (2) meals daily for live-in staff or provide a reasonable feeding allowance where meals are not provided.
  • 4.7.Salaries shall be paid monthly unless otherwise agreed with the Agency.

5Payments

  • 5.1.The Employer shall pay a professional consultancy fee as follows: ₦50,000 – Basic Subscription; ₦100,000 – Premium Subscription.
  • 5.2.Upon hiring a candidate, the Employer shall pay 25% of the staff's first monthly salary to the Agency. Failure to remit this payment forfeits the Employer's right to a free replacement.
  • 5.3.After payment of the 25% commission, all subsequent salary payments shall be made directly to the domestic staff.
  • 5.4.All payments to the Agency shall be made to the designated corporate bank account provided by the Agency.

6Replacement and Refund Policy

  • 6.1.If a staff leaves employment within one (1) year for reasons not caused by the Employer's breach, the Employer shall be entitled to a replacement at no additional recruitment fee within that period.
  • 6.2.A full refund of the professional fee shall be granted if no candidate is forwarded within thirty (30) days of payment.
  • 6.3.A 50% refund of the professional fee shall apply if the Employer discontinues the service within thirty (30) days of payment.
  • 6.4.If interviewed candidates are deemed unsuitable by the Employer, a 50% refund of the professional fee may be granted at the Agency's discretion.
  • 6.5.No refund shall be made once a candidate has been hired by the Employer.

7Confidentiality and Non-Compete

  • 7.1.Both parties agree to maintain confidentiality regarding all sensitive information obtained during the course of this engagement.
  • 7.2.The Employer shall not employ, within one (1) year, any candidate introduced by the Agency and previously declined. Breach of this clause shall attract liquidated damages of ₦200,000 payable to the Agency.

8Indemnity and Limitation of Liability

  • 8.1.While the Agency conducts security checks, it shall not be liable for any actions, misconduct, loss, or damages caused by the domestic staff during employment.
  • 8.2.The Agency may assist in locating a staff member where credible evidence of misconduct or criminal activity is presented.
  • 8.3.The Agency does not support salary advances and shall not be responsible for any loss arising from such arrangements.

9Assignment and Subcontracting

Either party may assign or subcontract aspects of this Agreement, provided that such assignment shall not relieve the assigning party of its obligations under this Agreement.

10Waiver

Failure by either party to enforce any provision shall not constitute a waiver of future enforcement of that provision or any other provision.

11Termination

  • 11.1.Either party may terminate this Agreement upon one (1) month's written notice.
  • 11.2.Where termination is initiated by the Employer, the applicable refund provisions under Clause 6 shall apply.

12Amendments and Updates

The Agency reserves the right to review, amend, modify, or update these Terms of Service at any time where necessary for operational, legal, or regulatory reasons. Any updated terms shall take effect immediately upon publication on the Agency's website. Continued use of the Agency's services constitutes acceptance of the revised terms.

13Acceptance

Execution of this Agreement by selecting "I Agree" during registration, or by electronic or physical signature, constitutes full acceptance of these Terms of Service.
